However, when the grantor/settlor/trustor (the person who creates the trust) passes away, there are many things that needs to happen. With a typical revocable trust, the grantor’s social security is used as the Trust’s tax ID number. When the grantor dies, the trust will need to get a new tax ID number. Sometimes trust assets will need to be retitled in the name of sub trusts per the trust document. A successor trustee will need to accept trusteeship. This can just be the tip of the iceberg when administrating a trust after the grantor passes away.
All trustees have a fiduciary obligation to act in the best interests of the beneficiaries. Therefore, the trustee must make sure to take inventory of trust assets, invest trust assets in a prudent manor, and provide accountings to the beneficiaries of the trust.
